A Silver City police officer was dispatched to 1204 Glenda Circle at about 6:33 p.m. on Monday, May 6, in reference to a weapons-fired complaint. According to a police report, when the officer arrived, he observed a male standing at the front door to 1207 Glenda Circle arguing with two females. He observed one of the females had an injury to the right side of her face and the right side of her shoulder and upper arm that appeared to be powder burns. However, the report stated, the female refused to tell the officer what happened.

The male, Derek Cipares, 37, of Silver City, told officers according to the report, that he was asleep when he heard someone inside his residence and heard one state “I’ll hit a m*****f****r.” He stated he grabbed his shotgun and started shooting toward three people walking toward him. After placing Cipares in investigative detention and handcuffs, officers discovered multiple holes in the walls and bookshelves.

Officers recovered a black Mossberg 12-gauge shotgun by the front door, which was logged into evidence, the report stated.

The two females were then questioned as the one injured was being evaluated by EMS and, according to the report, stated they went into Cipares’ house to check on him after borrowing his truck and called out to him as there was no power in the house and it was dark inside. They told officers all of a sudden, they heard gunshots and ran out of the house as fast as they could. The uninjured female stated they were the only ones to enter the house. Cipares stated that both females had permission to be in his house.

A SCPD detective contacted an assistant district attorney. Neither a search warrant nor charges were approved on Cipares, as he was defending his home against what he believed to be intruders. The injured female was transported to GRMC for further evaluation, while the other female was released. Cipares was transported to the Grant County Detention Center for a previous unrelated warrant.
