David Montoya, 19, of Santa Clara, was booked into the Grant County Detention Center on Tuesday, Aug. 6, 2019, by Silver City Police Department officers on a charge of battery on a household member involving a pregnant 19-year-old female after an incident at the Lintero Apartments.

According to a SCPD blotter entry, a named female (victim), through Facebook, called a third party who called the Grant County Regional Dispatch Authority about 5:27 p.m. advising that the victim said David Montoya was there and he is not supposed to be there.

When officers arrived at the apartments about 5:33 p.m., Montoya told officers, according to the report, that when he advised the victim that he was going to take his son for four days to a week, she slapped him and he pushed her causing her to fall “dramatically.” However, the victim told another officer that Montoya had slapped her after she picked up the child and took him to the bedroom. At that time, the report stated, officers arrested Montoya, put him in handcuffs, and placed him in the back seat of a patrol car.

An officer walked through the apartment and, according to the report, advised he saw the apartment to be dirty and the floor sticky. The officer also noted the bedroom had broken glass on the floor and was dirty as well.

Bruises were noted on the victim’s face and after complaining of back pain and early contractions she was transported to Gila Regional Medical Center, while the baby was taken into custody by the New Mexico Children, Youth, and Families Department.

According to GCDC staff, Montoya was released by the court the next day, Wednesday, Aug. 7.
