On October 6, 2018, around 7:00 p.m., officers with the Deming Police Department (DPD) responded to a shots fired call at a residence on Diamond Street in Deming, NM. Upon arrival, officers discovered two subjects with gunshot wounds, one of whom died later at the hospital. DPD requested the New Mexico State Police to investigate this scene.

The New Mexico State Police Investigations Bureau assumed this investigation. Preliminary information indicates that on the evening of October 6, 2018 around 7:00 p.m., multiple occupants were inside the residence located at 2110 ½ S. Diamond Street in Deming when Eduardo Pena (27) and several other subjects attempted to rob the occupants at gunpoint. During the incident, Pena possessed a handgun and had pointed it at the occupants in the residence. 

An altercation ensued and Pena was shot by one of the occupants inside the residence. Pena was transported to the hospital but later died from his injuries. Another female subject who was present with Pena was also shot during the altercation. The female was transported to an area hospital where she remains in critical condition.

At this time no charges have been filed. This incident remains under investigation by the New Mexico State Police Investigations Bureau. Updated information will be released when available.
