According to a criminal complaint issued July 2, Brawn Aguirre, 33, of Silver City, has been charged with aggravated battery against a household member (great bodily harm), false imprisonment, and interference with communications in reference to a June 30 incident. Grant County Assessor Raul Turrieta told the Beat that Aguirre is employed at the assessor’s office.

In the criminal complaint, a New Mexico State Police officer stated as he was in the Ridge Road Chevron on June 30, at approximately 10:40 p.m., he observed a red Toyota 4Runner with a female driver pull into the gas station and park. As the officer was leaving the gas station, he saw the female exit the vehicle appearing to be upset and crying. The officer also saw at that time another vehicle with a male driver pull into the gas station and park near the female’s vehicle. The officer identified the male as the female’s brother.

The NMSP officer and the female’s brother both asked the female what was going on, the complaint said, and she replied that “Brawn and I had a fight.” She advised that she and her husband had been at a softball tournament all day and that he had been drinking.

After they returned home, the complaint stated, she advised that her husband saw a text on her phone from their daughter’s teacher about an individual educational plan (IEP) meeting and began yelling at her about lying to him. According to the complaint, the female described how her husband slammed her arm with the door in the bathroom doorway several times, and pushed her into the hallway.

At this time, the complaint stated, the female advised she was able to get her three children dressed and into a vehicle preparing to leave the house. However, Aguirre came outside, she advised, and forcefully drug her back into the residence by her leg. The complaint states that once inside the house the female advised that Aguirre slammed her head on the ground several times and began punching and choking her.

According to the complaint, the female advised that she was able to leave the house with the three children, ages 2, 4, and 7-years-old after Aguirre fell asleep. She then contacted her brother for help.

After photographing the victim’s injuries on her face, throat, shoulder and back, the complaint states that the NMSP officer requested the Silver City Magistrate Division Court I to send Aguirre a criminal summons to appear.
