CLOVIS, NM - Rep. Andrea Reeb (R-Clovis) resigned from the New Mexico House of Representatives today following a federal court ruling that her service as a legislator and as a special prosecutor cannot continue at the same time.
On October 14th, 2026, the U.S. District Court for the District of New Mexico ruled in Baldwin v. Morrissey that holding both roles violated the separation-of-powers provision of Article III, Section 1 of the New Mexico Constitution. Forced to choose between her legislative seat and the victims depending on her in court, Rep. Reeb chose the victims.
"There are victims and families across this state who have trusted me with their cases, and many of them have already waited too long for justice," said Rep. Reeb. "I made a commitment to stand with them in the courtroom, and I owe it to them to keep that commitment."
Rep. Reeb had relied on guidance from both the State Ethics Commission and the New Mexico Attorney General, whose 2024 opinion specifically addressed a legislator serving as a special prosecutor. While she disagrees with the federal court's conclusion, she said respect for the Constitution made resignation the right course.
"I respectfully disagree with the Court, but I respect our Constitution and the institutions that uphold it," Reeb said. "I won't let a legal fight stand between victims and the justice they deserve."
Rep. Reeb thanked the people of House District 64, calling it the honor of her life to represent them in the Legislature.
