LEGAL NOTICE

The Town of Silver City Council will hold their Regular Council Meeting scheduled for Tuesday, October 8, 2024, at 6 p.m. at the Grant County Administration Center, 1400 Hwy. 180 East, Silver City, New Mexico. The public is invited to attend. The agenda will include:
Approval of Minutes: Regular Meeting – September 10, 2024, Regular Town Council Meeting

11. NEW BUSINESS:

A. Approval / Disapproval of the Silver City Museum Mission Statement.
B. Approval/Disapproval of RFP 24/25-1RP Marketing Services
C. Approval / Disapproval of Resolution 2024-21 PARTICIPATION IN TRANSPORTATION PROJECT FUND PROGRAM ADMINISTERED BY NEW MEXICO DEPARTMENT OF TRANSPORTATION.
D. Approval / Disapproval of Resolution 2024-22: A RESOLUTION AUTHORIZING THE EXECUTION AND DELIVERY OF A COLONIAS
INFRASTRUCTURE PROJECT FUND LOAN/GRANT AGREEMENT
("AGREEMENT" OR "LOAN/GRANT AGREEMENT") BY AND BETWEEN THE NEW MEXICO FINANCE AUTHORITY ("NMFA," OR "LENDER/GRANTOR") AND THE TOWN OF SILVER CITY
("BORROWER/GRANTEE"), IN THE TOTAL AMOUNT OF THREE HUNDRED FORTY-FIVE THOUSAND FIVE HUNDRED DOLLARS ($345,500), EVIDENCING AN OBLIGATION OF THE BORROWER/GRANTEE TO UTILIZE THE LOAN/GRANT AMOUNT SOLELY FOR THE PURPOSE OF FINANCING THE COSTS OF THE DESIGN AND SURVEY OF ROADS AND DRAINAGE IMPROVEMENTS ON SWAN STREET, AND SOLELY IN THE MANNER DESCRIBED IN THE LOAN/GRANT AGREEMENT; PROVIDING FOR THE PLEDGE AND PAYMENT OF THE LOAN AMOUNT OF THIRTY-FOUR THOUSAND FIVE HUNDRED FIFTY DOLLARS ($34,550) SOLELY
FROM THE BORROWER/GRANTEE'S ORDINANCE NO. 671, ADOPTED ON AUGUST 17, 1981, WITH AN EFFECTIVE DATE OF JANUARY 1, 1982 IMPOSING A ONE-QUARTER OF ONE PERCENT (0.25%) INCREMENT OF THE MUNICIPAL GROSS RECEIPTS TAX FROM WHICH THE BORROWER/GRANTEE PLEDGES TO THE PAYMENT OF THE LOAN PAYMENTS ONE-EIGHTH OF ONE PERCENT (0.125%), WHICH MUNICIPAL GROSS RECEIPTS TAX HAS BEEN DE-EARMARKED AND IS NOW ENFORCEABLE UNDER NMSA 1978, § 7-19D-9, AS AMENDED; ACCEPTANCE OF A GRANT AMOUNT OF THREE HUNDRED TEN THOUSAND NINE HUNDRED FIFTY DOLLARS ($310,950); CERTIFYING THAT THE LOAN/GRANT AMOUNT, TOGETHER WITH OTHER FUNDS AVAILABLE TO THE BORROWER/GRANTEE, IS SUFFICIENT TO COMPLETE THE PROJECT; APPROVING THE FORM OF AND OTHER DETAILS CONCERNING THE LOAN/GRANT AGREEMENT; RATIFYING
ACTIONS HERETOFORE TAKEN; REPEALING ALL ACTION INCONSISTENT WITH THIS RESOLUTION; AND AUTHORIZING THE
TAKING OF OTHER ACTIONS IN CONNECTION WITH THE EXECUTION AND DELIVERY OF THE LOAN/GRANT AGREEMENT.

E. Approval / Disapproval of Resolution 2024-23: A RESOLUTION CONCERNING
THE PROPOSAL OF THE UNITED STATES AIR FORCE TO USE THE AIRSPACE OVER THE GILA NATIONAL FOREST AND GILA WILDERNESS FOR LOW ALTITUDE COMBAT TRAINING.
F. Approval / Disapproval of a Notice of Intent of Ordinance 1333 TO ADOPT AN
ORDINANCE AMENDING APPENDIX C, LAND USE AND ZONING CODE OF
2010, ARTICLE III, DISTRICT REGULATIONS, SECTION 3.2, USE TABLE,
AND SECTION 3.3, USE REGULATIONS, SUBSECTION 3.3.1, USE-SPECIFIC
STANDARDS, PARGRAPH 3.3.1 H), CANNABIS ESTABLISHMENTS,
SUBPARAGRAPHS 3.3.1 H) 2) a) THROUGH 2) i), OF THE MUNICIPAL CODE
OF THE TOWN OF SILVER CITY, GRANT COUNTY, NEW MEXICO, TO
PROVIDE ZONING AND REGULATION OF CANNABIS ESTABLISHMENTS
PURSUANT TO THE CANNABIS REGULATION ACT OF 2021, AS AMENDED.
